Terms and Conditions

These Terms & Conditions apply to the use of ShipEx India’s website, platforms, and mobile application (collectively, “Applications”). The Applications are the property of ShipEx India.
Access to and use of the Applications are exclusively available to entities and individuals of legal majority, who can form legally binding contracts under applicable law. Those not meeting these criteria are prohibited from using the Applications.
Graphics, icons, and all visual elements on the Applications are trademarks or service marks of ShipEx India. These Marks are not to be used without explicit permission. Users have no rights to ownership of any content or applications by accessing them. Content must not be altered, published, sold, or exploited without ShipEx India’s consent. Reverse engineering of the Applications is strictly forbidden.
ShipEx India reserves the right to alter these terms without notice. It is the user's responsibility to stay informed by reviewing the terms posted on the website.
ShipEx India may at any time revise these Terms & Conditions. Continued use of the Applications signifies acceptance of the revised terms. ShipEx India may modify or discontinue any aspect of the Applications at its discretion and without notice.
Services, content, and information on this website are provided on an 'as is' basis. ShipEx India, to the fullest extent permitted by law, disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose.
Use of the ShipEx India Applications and its content is at your sole risk. ShipEx India will in no event be liable for any direct, indirect, consequential, incidental, or other damages under any theory of law for any errors in or the use of or inability to use the ShipEx India Applications and its content.
These Terms & Conditions are governed by the laws of India, and the courts in Mumbai will have jurisdiction over any disputes arising out of or in relation to the Applications or these Terms & Conditions.

1. We are committed to providing the highest level of protection regarding the processing of our employees’, vendors’ and customers’ personal data based on applicable data protection laws and regulations.

This Privacy Policy explains how AVN Business Solutions Private Limited providing services under the brand name of ‘Shipyaari’ may collect, use, store, disclose or otherwise process your personal data including personal data provided when using our website or any of Shipyaari applications, and describes the rights you have with respect to your personal data.

Types of Personal Information collected by the Company: While using our Services, we may collect the following categories of Personal Information from the Users: Name, User ID, Email address, Address, Gender, Age, Phone Number, Password chosen by the User, Geographical location through the IP address of the Users, Financial account information like bank account details, GST certificate, PAN Card, etc., and transactional information in relation to transactions where the Company is involved; Any of the aforesaid information pertaining to the customer/buyer of the User, All other personally identifiable information/details as the User may share from time to time (including personally identifiable information/details of the customer/buyer of the User).
4. Access to Personal Data: Your personal data processed by us is only accessible by a limited list of recipients on a need-to-know basis or where required by law.
5. Our policy does not apply to third-party websites where our online advertisements are displayed, nor to linked third-party websites which we do not operate or control.
6. We never sell, trade or rent any Personal Data, for any purpose. We only share Personal Data with third parties in connection with the provision of the services to our users, such as sellers, business partners. This disclosure may be required for us to provide you access to our products/services, for fulfilment of your orders; for enhancing your experience; for providing feedback on products, to collect payments from you, to comply with our legal obligations, to conduct market research or surveys; to enforce our Terms of Use, to facilitate our marketing and advertising activities, to analyse data, for customer service assistance, to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services.

10. Opt-out: If the User wishes to opt out of receiving non-essential (promotional, marketing-related) communications from us, after setting up an account, they may choose to do so.
11. Grievance Redressal: Any complaints, abuse and concerns with regard to content or breach of the terms may be informed to the designated Grievance Officer.
12. Changes to this Privacy Policy: Shipyaari may in its absolute discretion update this policy from time to time.

Refund and Cancellation Policy

1. You can anytime ask our agents to deactivate your account.
2. Data in your account shall be kept for another 90 days if you wish to resume the account.
3. Once the data is deleted there is no way of retrieving it back.
4. Wallet amount shall not be refunded in any case.
5. Shipment Cancellation charges will be processed and credited to wallet within 7 working days
6. Subscription charges paid shall not be refunded in any case.
7. Any dispute related to service and credit/debit notes shall be settled in the wallet only.
8. Post deactivating you may still receive invoices for those shipments which were not billed earlier or for which there are changes in the shipping details and the same shall be payable if in case not paid in advance.
9. We reserve the right to modify the terms and conditions of our services at any time and shall be notified.
10. In case it is found that you/user is involved in any fraudulent activities involving our services, then your account may be put on hold or can be deactivated unless satisfactory reasons are provided.
